At the end of each year, workers receive an extra payment called Christmas bonus, which must be at least 15 days of salary. According to the Procuraduría Federal de la Defensa del Trabajo (Profedet), the only workers who do not receive it are those who are hired as professional service providers “except in the case where there is a subordinate relationship”.
That is to say, it does not matter if you are a base worker, a regular worker, a unionized worker, or if your contract is temporary, for a specific period of time or by work. As long as there is a subordinate relationship, you are entitled to receive this payment.
Now, how is the Christmas bonus calculated? Profedet explains that to calculate it you only have to find out what your daily base salary is or what you receive for a day’s work. Once you have that figure you only have to multiply it by 15 and that’s it.
We should mention that the full Christmas bonus is given for one yearof work. If you have worked less than that period, you will receive a bonus, but only a proportional part.
In the case of workers who resigned or were dismissed, they are also entitled to receive Christmas bonus. In the case of dismissals, this money is given together with the severance payment or liquidation.
When does the Christmas bonus 2024 have to be paid? By law, the deadline to do so is December 20.
If you do not receive it, the place where you work may be subject to a fine ranging from 50 to 500 UMAs, that is, between $5,428.50 and $54,285.
